Dean Santa Maria Explains Rights of Persons Arrested, Detained or Under Custodial Investigation

 Dahil sa dami ng naaaresto ng mga pulis ngayon, Dean Santa Maria nagpaliwanag kung ano ang mga dapat tandaan o malaman tungkol sa ating mga karapatan ang responsibilidad ng pulis. Narito ang mga paliwanag ni Dean Santa Maria tungkol sa mga karapatan ng isang inaresto o inimbitahan sa presinto para imbistigahan:

"ANO ANG KARAPATAN NG ISANG INARESTO O INIMBITAHAN SA PRESINTO para imbistigahan? HINDI DAPAT SIYANG mag-isa. HETO:"


Republic Act No. 7438 Section 2 (f): Any person arrested or detained or under custodial investigation shall be allowed visits by or conferences with any member of his immediate family, or any medical doctor or priest or religious minister chosen by him or by any member of his immediate family or by his counsel, or by any national non-governmental organization duly accredited by the Commission on Human Rights of by any international non-governmental organization duly accredited by the Office of the President. The person's "immediate family" shall include his or her spouse ( asawa), fiancé or fiancée ( kasintahan), parent (magulang)or child (anak), brother or sister (kapatid), grandparent Lolo at lola) or grandchild (apo), uncle ( tiyo) or aunt (Tiya), nephew or niece ( pamangkin), and guardian (tagapag-alaga) or ward (inaalagaan).

 

Sabi rin ng batas : "custodial investigation shall include the practice of issuing an "invitation" to a person who is investigated in connection with an offense he is suspected to have committed, without prejudice to the liability of the "inviting" officer for any violation of law." ( Section 2 last paragraph RA No. 7438)

 

Ang pagsasalarawan nga ng Supreme Court sa "invitation" ay isa lamang uri ng "euphemism for an arrest without warrant" ( People vs. Dilao G.R. No. L-43259 October 23, 1980). Kaya BASTA Kayo ay naimbitahan ng pulis sa pamamagitan ng subpoena or anumang paraan para tanungin sa diumanoy isang ginawa nyo:

1.Alamin ang pangalan ng pulis o autoridad;

2.)  Malumanay ng tanong kung may warrant of arrest;

3.)  tawagan ang inyong abogado;

4.)  Madami ang nasapaligid ninyo para mga saksi

 

Kung hindi mapipigilan ang mapasama, TANDAAN NINYO , KARAPATAN ninyong mabisita o samahan ng inyong abugado, doktor, pari, o representante ng NGO, asawa, kasintahan,magulang, anak, mga kapatid, Lolo at lola,apo, tiyo, Tiyapamangkin, tagapag-alaga o inaalagaan. MASMADAMI MASMABUTI. Hindi dapat ipagkait ito sa inyo.

 

Heto ang parusa sa mga lalabag: "Any person who obstructs, prevents or prohibits any lawyer, any member of the immediate family of a person arrested, detained or under custodial investigation, or any medical doctor or priest or religious minister chosen by him or by any member of his immediate family or by his counsel, from visiting and conferring privately with him, or from examining and treating him, or from ministering to his spiritual needs, at any hour of the day or, in urgent cases, of the night shall suffer the penalty of imprisonment of not less than four (4) years nor more than six (6) years, and a fine of four thousand pesos (P4,000.00). (Section 4 (b) RA 7438)

 

Kung nagiisa po kayo sa presinto, wala na po kayong control. At sabi ng Supreme Court ,"a man of ordinary or average composure may yield to a skilled investigator or one who though unskilled is prone to brutal techniques." ( People vs. Dilao). MAGINGAT RIN PO --- Dean Mel Sta Maria."
